@anja & @kwils1 - this is exactly what i was curious about. There was this legal letter issued a while back by the vacation rental owner association. Has anyone heard of any development in this direction? The bill SB2089 is clearly discriminatory and its legal grounds do sound very quesitonable. I would like to see that senators are aware of that attorney's letter. I also found the following blog post to be consice and informative as far as statistics and voices from real people go: http://blog.rentini.com/2012/03/05/sb2089-set-to-pass-unless-opposition-shows-their-numbers/
Well written article. Thanks

The full Senate? Do you know what the vote was?
Kristin,
Could you be specific? Do you mean 2089 has been passed by the Senate and
is headed to the House?

Totally unconstitutional. This will be challenged at the Federal level if passed.
How discouraging. Again, I can't believe they
even read the letters we sent them.
I cannot understand this passing. It is mind-boggling to me. I understand that they want to collect their taxes, but this bill is still discriminatry and I do believe unconstitutional. If it was a good way to do enforce uncollected taxes, wouldn't other states have laws like this. I don't believe any other states have a similar law.I truly feel that it MUST be unconstitutional. I am not a lawyer, but someone out there, please help us!!!

Thank you for the link. It's a good article. But, you know...I just have not been seeing a lot of PRESS about this, overall. Maybe that article will kick start some wider interest.
And, this illustrates what I and 'sadamo/David' have been saying:...these Senators do not care a hoot about the peoples' position. The testimonies sent are not having impact. It's just a few testimonies from owners and visitors to Hawaii -the State's loyal investors and consumers- and they appear to have ZERO affect on them. What we have here is a very bias mindset...they are not willing to give time for open discussion and debate from opposing sides... to hear testimonies. Kafka! These senators and PMs are driven. And, I believe that the governor is like-minded! Unless the governor is presented with very compelling legal points, directly from a reputable law office in Hawaii...or outside Hawaii...preferably both....the governor will sign this thing into law. He is tax hungry. The State has been grossly mismanaged economically and the D's solution to everything is to TAX THE PEOPLE....and they see vacation rental owners as "rich" people who can afford "expensive real estate"....so they must be able to "pay more". They could care less about "reality" ...where is the fact finding data on "non-resident" tax evasion? It simply does not exist. Kafka!
We need lawyers
The legislature has no clue about economics. The do not realize the
financial devastation these bills will cause. The unions run the
legislature. The hotel unions hate us.
